Origamigos Terms of Service

Welcome to Origamigos, the Origami Spirit Membership! We’re thrilled to share the joy of origami with you through our tutorials, videos, live sessions, and community. These Terms of Service (“Terms”) are a binding agreement that governs your use of Origamigos to ensure a creative, respectful, and fun experience for everyone. 1. Definitions

  • Origamigos: The Origami Spirit Membership program, including all tutorials, videos, live sessions, and other benefits.
  • Content: All materials provided through Origamigos, such as videos, printable patterns, interviews, and community posts.
  • Service: The Origamigos platform and related services, including our website and any associated apps or groups.
  • You: The individual or entity subscribing to or using Origamigos.
  • We/Us/Origami Spirit/OrigamiSpirit Membership/Origamigos is a sole proprietorship based in the state of Vermont, United States of America

2. Eligibility

To join Origamigos, you must:

  • Be at least 13 years old. If you’re under 18, you need parental consent to use the Service.
  • Provide accurate and complete information during registration.
  • Agree to follow these Terms and all applicable laws.
  • Origamigos is designed for young and young-at-heart origami enthusiasts, but we reserve the right to refuse service to anyone who does not meet our eligibility criteria or to verify eligibility (e.g., age) if necessary.

3. Membership and Subscriptions

  • Access: Origamigos is a subscription-based service providing access to exclusive origami tutorials, live folding sessions, interviews, and a private community (e.g., Facebook group).
  • Subscription Plans: You may choose a monthly or annual subscription. Details of each plan, including exclusive tutorials and community access, are available on our website.
  • Non-Transferable: Your Membership is personal to you and cannot be shared, transferred, or gifted to others without our written consent.
  • Account Security: You are responsible for keeping your account credentials confidential and for all activities under your account.

4. Payments and Billing

  • Fees: Subscription fees are charged in advance at the start of each billing cycle (monthly or annually). Prices exclude applicable taxes, which you are responsible for paying.
  • Payment Methods: We accept payments via credit card. You must provide valid payment information to maintain active access.
  • Failed Payments: If a payment fails, we may retry the charge up to three times. If payment remains unsuccessful, we may suspend your access until resolved.
  • Price Changes: As long as you maintain an active, continuous Membership, your subscription price will remain the same as when you signed up. If you cancel and rejoin, you may be subject to the current pricing. We may adjust prices for new or returning members with at least 30 days’ notice via email or on our website.
  • Unauthorized Payment Methods and Chargeback Liability: Members are responsible for ensuring that all payment methods used for membership fees are authorized for their use. The use of unauthorized payment methods (e.g., using a credit card without the cardholder’s permission) is strictly prohibited and may result in immediate suspension or termination of your membership account. If a payment is disputed or results in a chargeback, the member will be liable for any associated fees, penalties, or costs incurred by Origami Spirit Membership as a result of the dispute. Origami Spirit Membership reserves the right to suspend or terminate access to all services until all outstanding fees and penalties are resolved. Members must promptly notify Origami Spirit Membership of any changes to their payment method to ensure compliance with this policy.

5. Cancellation and Refunds

  • Cancellation: You may cancel your Membership at any time by emailing leyla@origamispirit.com or through our website contact page. Cancellation takes effect at the end of your current billing cycle, and you will retain access until then.
  • Refunds: Subscription fees are non-refundable, except as required by law. We do not offer partial refunds for mid-cycle cancellations.
  • Promotional or Trial Periods: If a promotional or trial period is offered, you may cancel before the period ends to avoid charges. Trial terms will be clearly stated at signup.

6. Intellectual Property

  • Ownership: All Content provided through Origamigos, including tutorials, videos, and printable patterns, is owned by Origami Spirit or its licensors.
  • License: We grant you a limited, non-exclusive, non-transferable license to access and use Content for personal, non-commercial purposes. You may not copy, distribute, modify, or create derivative works from Content without our written permission.
  • Feedback: If you provide feedback or suggestions about Origamigos, we may use them without obligation or compensation to you.

7. User Content

  • Your Contributions: If you submit content (e.g., photos of your origami, comments in the community, or designs during live sessions), you grant Origami Spirit a worldwide, royalty-free, non-exclusive license to use, display, and reproduce such content for promotional, educational, or community purposes.
  • Your Responsibility: You represent that your content does not infringe on any third-party rights (e.g., copyrights, trademarks) and complies with these Terms.
  • Moderation: We may review, edit, or remove your content to align with creative content objectives or if it violates these Terms.

8. Prohibited Conduct

You agree not to:

  • Use Origamigos for any illegal or unauthorized purpose.
  • Share your account credentials with others.
  • Copy, distribute, or sell Content without permission.
  • Harass, defame, or harm other members or our staff.
  • Use automated tools (e.g., bots) to access or scrape the Service.
  • Attempt to hack, reverse-engineer, or disrupt Origamigos.
  • Post or share content that is offensive, misleading, or infringes on others’ rights.
  • Engage in any other conduct that, in our sole discretion, harms Origamigos or its users.

9. Termination – Cancellation

  • By You: You may terminate your Membership by canceling your subscription as described in Section 5.
  • By Us: We may suspend or terminate your access to Origamigos if you violate these Terms, fail to make payments, or engage in conduct that harms the Service or community. Upon termination, your access to Content will cease, and no refunds will be issued.
  • Surviving Terms: Sections 6 (Intellectual Property), 7 (User Content), 10 (Limitation of Liability), 13 (Dispute Resolution), and 14 (Governing Law) will survive termination.

10. Limitation of Liability

To the fullest extent permitted by law:

  • Origami Spirit is not liable for any indirect, incidental, or consequential damages arising from your use of Origamigos, including technical interruptions, errors in Content, or loss of data.
  • Our total liability shall not exceed the amount you paid for the Membership in the preceding 12 months.
  • Origamigos is provided “as is,” and we do not guarantee that the Service will be error-free or uninterrupted.

11. Privacy

Your use of Origamigos is also governed by our Privacy Policy. We collect and use your personal information to provide and improve the Service.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service or legal requirements. Your continued use of Origamigos after the effective date constitutes acceptance of the updated Terms.

13. Dispute Resolution

Any disputes arising from these Terms or your use of Origamigos will be resolved through binding arbitration in Vermont, USA, under the rules of the American Arbitration Association. You waive the right to participate in class actions or class-wide arbitration. Each party will bear its own costs and attorneys’ fees, unless the arbitrator awards otherwise. Notwithstanding the above, either party may seek injunctive relief in a court of competent jurisdiction for matters related to intellectual property or unauthorized use of the Service.

14. Governing Law

These Terms are governed by the laws of the State of Vermont, USA, without regard to its conflict of law principles. Any legal actions not subject to arbitration will be handled in the state or federal font courts of Vermont. #governing-law

15. Force Majeure

Origami Spirit is not liable for delays or failures to perform due to events beyond our reasonable control, such as natural disasters, server outages, or government actions.
